Family member of an EU citizen
A family member of a European Union citizen is considered to be a family member of a citizen of any EU Member State that is:
- a spouse, or registered partner;
- a parent, if the EU citizen is under 21 years or age and the parent actually looks after him/her;
- a child under the age of 21 or the child of a spouse who is an EU citizen;
- a child or parent or child or parent of the spouse of a European Union citizen if he/she is dependent on the maintenance or other necessary care provided by an EU citizen or his/her spouse in order to satisfy his/her basic needs or was dependent on such maintenance or other necessary care immediately before entering the territory in the state of which he/she is a citizen or in the state for which he/she had a residence permit.
A family member of an EU citizen is also considered to be a foreign national who:
- is relative of a EU citizen not specified above if
- he/she lived with an EU citizen in a common household in the state of which he/she is a citizen or in the state in which he/she had a residence permit before entering the territory;
- he/she is dependent on the maintenance or other necessary care provided by an EU citizen or his/her spouse in order to satisfy his/her basic needs or was dependent on such maintenance or other necessary care immediately before entering the territory in the state of which he/she is a citizen or in the state for which he/she had a residence permit;
- he/she is unable to look after him/herself without the personal care of an EU citizen on serious health grounds;
- has a permanent partnership relationship that is not marriage with an EU citizen and lives with him/her in a common household.
